Guest Terms of Use

In short

These terms cover the AI host on a restaurant's website. The host is an AI that Maitre runs for the restaurant. It is not a person. Your chat is recorded, and Maitre and its AI provider, OpenAI, process it to answer you. Answers can be wrong, so check allergies, prices and anything about safety with the restaurant's staff. Orders are with the restaurant and are paid on Square's page. Virginia law applies, and disputes go to Virginia courts. There is no arbitration.

1. Who you are talking to

The host on this restaurant's website is an AI assistant. Maitre runs it for the restaurant. "Maitre," "we" and "us" mean Jeshwanth Anthony, doing business as HireMaitre, of Arlington, Virginia. The host is not a person, and it will say so if you ask. Before your first message, the note under the message box says so. After that, a shorter note stays: "AI can make mistakes · Chats are recorded · Privacy"

The restaurant is a separate business. Maitre is not the restaurant, and neither is Square.

2. How you agree

Before your first message, this note sits right under the message box:

"AI, not a person. Chats are recorded by Maitre & OpenAI. AI can make mistakes, so check important info, like allergies, with staff. By chatting, you accept the Terms and Privacy."

In that note, "Terms" opens these Guest Terms and "Privacy" opens the Guest Privacy Notice. When you send a message, tap a suggested question or start a voice call while that note is showing, you agree to these Guest Terms. The pop-up greeting shows a shorter line under its buttons, "AI, not a person · Recorded by Maitre & OpenAI · Privacy", and tapping one of its buttons is agreement too. If you do not agree, do not use the host. You can contact the restaurant directly instead.

3. Recording and processing

Your chat is recorded. Maitre and its AI provider, OpenAI, process it for the restaurant, and the restaurant can read it. If you start a voice call, your voice is sent live to OpenAI to turn it into text and to tell when you have finished speaking. Maitre does not keep the audio after the call.

Maitre keeps your messages only as the restaurant's service provider and uses them for no purpose of its own. Maitre does not use them to train AI models, and OpenAI's terms for this service say it does not train its models on them either.

Do not share card numbers, passwords or anything you do not want processed this way. The Guest Privacy Notice explains what is kept and for how long.

4. The host can be wrong

THE HOST CAN MAKE MISTAKES. DO NOT RELY ON IT AS YOUR ONLY SOURCE OF TRUTH, OR INSTEAD OF TALKING TO THE RESTAURANT'S STAFF.

Before you rely on an answer, check these with the restaurant: allergies, ingredients, cross-contact, diets (including religious diets), prices, what is available, alcohol rules, and anything about safety.

The host cannot call for help and is not for emergencies. In an emergency, call 911.

5. Orders

If you place an order, your order is with the restaurant. The restaurant is the seller. It sets the prices, taxes, fees, refunds and pickup terms. Square takes payment on its own secure page under its own terms, and Maitre never sees your card number.

If the chat and Square's checkout show different prices or items, the checkout is what counts. Orders are for pickup only. You must be at least 18 to place an order.

6. Age

The host is not meant for children under 13. If you are under 18, use it only with a parent's or guardian's permission, and do not place an order.

7. Fair use

Do not use the host to send unlawful, abusive or harassing content, to attack or overload the service, or to try to get the host's instructions or another restaurant's information. Usage limits apply, and they may pause the host for a while.

8. No warranty

TO THE EXTENT THE LAW ALLOWS, THE HOST IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. MENU, ALLERGEN, PRICE AND HOURS INFORMATION COMES FROM THE RESTAURANT, AND MAITRE DOES NOT CHECK IT.

9. Limit of liability

TO THE EXTENT THE LAW ALLOWS, MAITRE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ABOUT THE HOST IS LIMITED TO ONE HUNDRED US DOLLARS ($100). THIS LIMIT DOES NOT APPLY TO DEATH OR PERSONAL INJURY CAUSED BY MAITRE'S NEGLIGENCE, TO MAITRE'S FRAUD, GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR TO ANY LIABILITY YOUR STATE'S LAW DOES NOT ALLOW TO BE LIMITED. CLAIMS ABOUT FOOD, ORDERS, REFUNDS AND SERVICE ARE AGAINST THE RESTAURANT, NOT MAITRE.

10. Disputes

Virginia law governs these terms, without regard to its rules on conflicts of law. You keep any protection your home state's law gives you that cannot be waived.

If something goes wrong, please email team@hiremaitre.com first with your name, how to reach you and what happened. We will try to fix it within 60 days.

Any claim must be brought only in the Circuit Court of Arlington County, Virginia, or the United States District Court for the Eastern District of Virginia, Alexandria Division, or, for a claim within its limits, the General District Court of Arlington County, Virginia. You and Maitre agree to those courts' jurisdiction. There is no arbitration for guests.

11. Changes and contact

We may update these terms. The version and dates are at the top of this page. A change applies to chats that start after it is posted, and it never applies to a dispute you have already raised with us.
